Checking a Brand Name Before Trademark Registration: Search and Interpret Results

Screen the brand name without treating it as approval

Before ordering large quantities of packaging or signs, screen the intended brand name and retain results for professional advice. Thailand's Department of Intellectual Property explains that a search is preliminary; registration remains subject to the registrar's assessment of the facts and legal criteria. When a search returns no matches, this should not be interpreted as permission or a guarantee of registration.

Define the name and design you intend to use

List the Thai and English names, pronunciation and logo designs you actually intend to use. Keep alternative candidates in separate sets rather than mixing versions. Where both words and graphics are involved, retain clear dated files. Giving only an informal brand nickname may not represent the mark to be filed or used on products. Do not display a symbol claiming registration before checking the status.

Describe actual goods and services before narrowing the search

Explain in plain language what the business sells or does, separating current activities from planned additions. The Department's search system provides goods and services classification information, but selecting a class number alone does not replace an appropriate specification. If you are unsure how a result relates to your business, retain the details for professional review. Do not assume that different classes always eliminate risk.

Keep a reproducible search record

Start with the intended name, then consider spelling, pronunciation or graphic elements that may be similar, using the tools the system supports. Record search terms, filters, date and application or registration numbers of relevant results, with detailed screenshots. If the system fails to display results or load completely, record that the check could not be completed rather than concluding that no similar marks exist.

Separate search facts from legal conclusions

For results needing further review, note similarities in pronunciation, appearance or goods, together with the status displayed on the search date. Do not independently treat a particular status as proof that the name is safe to use, or judge similarity from one thumbnail. For example, differently spelled names with similar pronunciation should be retained as a question rather than dismissed because every letter does not match.

Seek an assessment before investing further in the brand

Provide the intended name and design, goods and services list, dated search results and unresolved questions to your adviser. Ask whether additional searching, design changes or further information are needed before filing. Preliminary screening organizes questions; it does not replace a rights assessment or guarantee registration.
