Must Heirs Pay All of a Deceased Person's Debts in Thailand?

Family relationships alone do not establish the amount owed

When a creditor contacts you after a family member dies, do not immediately assume that descendants must pay every amount from personal funds or that death cancels all debts. Ask whose debt is claimed, which contract it concerns and in what capacity you are being contacted. Keep letters, messages and receipt dates. Understanding liability limits is separate from checking claims and responding through the required procedures.

An estate may include assets and liabilities

Section 1599 of Thailand's Civil and Commercial Code addresses the passing of an estate on death. Section 1600 includes property, rights, duties and liabilities, with exceptions for matters strictly personal to the deceased under law or by their nature. Section 1601 limits an heir's liability to the estate property devolving on that heir. This does not mean unlimited repayment by heirs, nor does it mean every debt ends when a borrower dies.

Separate inheritance from contracts you signed

Clarify whether the demand relies on your status as an heir or alleges that you are a joint debtor, guarantor or another contracting party. If you signed documents, give a lawyer complete copies and amendments. Do not automatically use Section 1601 to answer liabilities that may arise under your own contracts. A family label or acting as the funeral coordinator alone does not establish the contractual basis alleged by the creditor.

Keep separate asset and debt schedules

List property connected with the deceased, evidence of ownership, sourced valuations, current holders and whether distribution or receipt has occurred. Separately record claimants, contract references, claimed principal, interest or charges, and payment evidence. Distinguish verified figures from disputed amounts. For example, an estate may involve deposits and land co-owned with others; do not count the value of the whole plot as property devolving on you before checking the rights involved.

Do not set aside a demand or court summons

Even if you believe your liability is limited, do not ignore demands or court documents. Preserve envelopes, receipt dates and every page, then have a lawyer examine the debt's basis, evidence and actual deadlines. Before signing an acknowledgement of debt, instalment agreement or settlement, understand your signing capacity and the consequences. This general article does not calculate limitation periods or the deadline for filing a defence in your case.

Bring clear questions about the basis of each debt

When contacting B Law Firm, start with a short chronology including the death date, demand documents, asset and debt schedules, and any contracts you signed. Ask which issues concern estate debts, which concern another person's obligations and what further evidence is needed. This general information does not decide who qualifies as an heir, how much property anyone receives or the outcome of litigation. Reading it cannot replace examination of the particular facts and documents.
